StumpFast — Terms of Service

1. What StumpFast is

StumpFast ("we," "us," the "Service") is software that helps tree and stump service contractors ("Contractors") collect photos from their customers ("Customers") and generate estimates. AI analyzes submitted photos to estimate stump dimensions; the Contractor's own pricing settings turn those estimates into a quoted price.

These Terms apply to both Contractors (who hold accounts) and Customers (who use quote links). By creating an account or submitting photos through a quote link, you agree to these Terms.

2. Estimates are estimates — the core disclaimer

• AI measurements are automated estimates based on photos and can be wrong. Photo quality, angle, lighting, and reference-object placement all affect accuracy.
• Quotes generated through StumpFast are the Contractor's quotes, not ours. The Contractor sets all pricing and is solely responsible for reviewing measurements and for any price they honor, adjust, or decline.
• For Customers: any estimate you receive is preliminary and subject to confirmation on site by the Contractor. StumpFast is not a party to any agreement between you and a Contractor.
• We are not responsible for the quality, safety, legality, scheduling, or completion of any work performed by Contractors.

3. Contractor accounts

• You must provide accurate business information and keep your login credentials secure. You are responsible for activity under your account.
• You represent that you are authorized to operate the business you register and to perform the services you quote.
• You must have any licenses and insurance required for your trade in your jurisdiction. StumpFast does not verify licensing.

4. Customer submissions and communications

• Customers must provide accurate contact information and may only submit photos of property they own or are authorized to photograph.
• By providing a phone number or email, Customers consent to being contacted about their estimate by their Contractor (and by StumpFast on the Contractor's behalf, e.g. delivery of the quote).

5. Text messaging (SMS) program

Program: StumpFast Quote Updates — transactional text updates about a stump grinding quote request, sent on behalf of the Customer's chosen Contractor (for example: photos received, quote ready, booking confirmed).

• Opt-in: you consent to receive these texts by entering your phone number in a quote request form, which discloses that you will receive updates about your quote. We do not send marketing texts.
• Message frequency varies by quote request — typically 1–4 messages per request. Message and data rates may apply.
• Opt-out: reply STOP to any message to cancel. Reply HELP for help, or contact terms@stumpfast.com.
• Mobile carriers are not liable for delayed or undelivered messages.
• Your consent to receive texts is not a condition of purchasing any goods or services.

6. Photos and content — license to us

You keep ownership of the photos and content you submit. You grant StumpFast a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, and display that content to operate, secure, and improve the Service — including analyzing photos with AI systems and using content to develop and improve measurement accuracy and machine learning models. Where content is used to improve models, we use it in de-identified form (see the Privacy Policy; location metadata is stripped from photos at upload).

If you do not want a specific photo used for service improvement, contact us at terms@stumpfast.com and we will exclude or delete it.

7. Fees

• Contractor subscription: $49/month after a 14-day free trial. No charge without payment details being provided and confirmed.
• Fees are billed monthly and are non-refundable except where required by law. We may change pricing with 30 days' notice.
• The Service is free for Customers.

8. Acceptable use

You may not: misuse or attempt to disrupt the Service; upload unlawful, infringing, or malicious content; scrape or resell the Service; use it to send spam; or submit photos of people where prohibited by law. We may remove content or suspend accounts that violate these Terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY OF ANY MEASUREMENT OR ESTIMATE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) STUMPFAST IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING FROM THE SERVICE OR FROM WORK PERFORMED BY ANY CONTRACTOR; AND (b) OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS PAID TO US BY YOU IN THE 12 MONTHS BEFORE THE CLAIM (OR $100 IF YOU HAVE PAID NOTHING).

11. Indemnification

Contractors agree to indemnify StumpFast against claims arising from their services, their quotes, their content, or their violation of these Terms.

12. Termination

You may close your account at any time. We may suspend or terminate accounts for violation of these Terms with notice where practicable. Sections 2, 6, 9–11, and 13 survive termination.

13. General

• Governing law: the laws of the State of California, USA; venue in the state and federal courts located in California.
• We may update these Terms; material changes will be notified to account holders 30 days in advance. Continued use is acceptance.
• If any provision is unenforceable, the rest remain in effect.
• These Terms plus the Privacy Policy are the entire agreement between you and StumpFast regarding the Service.
